Zoning By-Laws Affecting Fairmile Estates

Zoning By-law 84-77
ESTATE RESIDENTIAL ZONE (RE) Zone Provisions
No person shall within any RE Zone use any lot or erect, alter or use any building or structure except in accordance with the following provisions:
LOT AREA (minimum): 0.8 hectares (2 acres)
LOT FRONTAGE (minimum): 60.0 metres
FRONT YARD DEPTH (minimum): 18.0 metres
EXTERIOR SIDE YARD WIDTH (minimum): 18.0 metres
INTERIOR SIDE YARD WIDTH (minimum): 9.0 metres
REAR YARD DEPTH (minimum): 9.0 metres
DWELLING UNIT AREA (minimum): 92.9 square metres (1,000.0 sq. ft.)
GROUND FLOOR AREA (minimum):
1. One storey dwelling house - 92.9 square metres
2. One and one-half storey dwelling house - 73.0 square metres
3. Two storey dwelling house - 66.4 square metres
LANDSCAPED OPEN SPACE (minimum): 70%
LOT COVERAGE (maximum): 8%
BUILDING HEIGHT (maximum): 10.5 metres
DWELLING HOUSES PER LOT (maximum): 1 only
In addition to Rideau Township Zoning Bylaw requirements, the following conditions are registered on title by Fairmile Estates for the benefit of Lots 1 to 40 both inclusive:
- No structure shall be erected, altered, placed or permitted to remain on any lot other than one single family detached dwelling and one single or double attached garage, and such accessory buildings or structures as may be approved by Fairmile Estates;
- Notwithstanding the provisions of the Township of Rideau Zoning By-Law, other buildings or structures accessory to the dwelling unit are prohibited unless approved in writing by Fairmile Estates;
- At all times during construction, keep any roadways and drainage swales, within or outside the subdivision, free and clear of any excavation materials, building materials, soil, sand, gravel, mud, construction scraps, rubbish and other debris from the lot and take all necessary precautions to ensure that such roadways and swales and any services and installations within the subdivision will not be damaged by any construction vehicles, machinery and equipment working on the lot;
- Keep any drainage swales clear, cut and clean and whenever and wherever necessary, restore the drainage swales (including the replacement of sod where necessary) to the shape and grades indicated on the grading plan of the said lot or lots approved by the Township Engineer, and maintain drainage at all times during construction and thereafter; and,
- The exterior of any building erected on a lot must be completed within one year after the date of commencement of construction thereof.
